What can be considered unfair practices?
There are several unfair practices that employers will try to use to avoid paying their employees overtime, such as:
- Employee Classification – companies will classify employees as independent contractors or managers because executives and contractors are exempt from being paid overtime wages
- Donning and Doffing – employees who are required to wear protective clothing on the job will be asked to work off-the-clock when dressing (or donning and doffing their gear) before and after work
- Meal Periods – employees will be asked to work through lunch and off-the-clock—to be considered an acceptable meal period, workers must be allowed to take a 30-minute, uninterrupted lunch away from their work station
