What are your rights if you’ve been injured?

There are two basic court systems across the United States. Each state has its own state court system. These are all the local courthouses that can be found in virtually every county across the United States. For each state court system there is a state appeals court and most states have their own state supreme court. But there is also the federal court system. While the federal court system is also in every state and territory of the United States, none of these federal courthouses are part of the state court systems. They are totally separate systems with only one common factor, and that is that the top court for both the federal and the state court systems is the Supreme Court of the United States. This is the system that was set up the framers of our constitutional system who decided to separate out the state court systems from the federal court system. Anytime a lawyer gets ready to file a lawsuit for an injury claim, that lawyer must first decide where they can file the lawsuit. Some lawsuits can be filed in either federal court or state court. In some cases, the person being sued has a right to demand that the case be heard in federal court. The rules are complicated but an experienced lawyer can usually determine how to best protect their client’s rights.

If you believe texting while driving isn’t dangerous- think again

Having been a personal injury lawyer now for more than 25 years, when I am out driving I am always watching what other drivers are up to. Over the last several years it is clear to me that a very large number of people are now texting while driving. We can all see it as we drive down the roads – people in front of us, beside us or behind us constantly nodding their heads up and down as they read their texts and emails.

A report came out about another horrible crash caused by texting. This one happened a year ago in Missouri and killed two people and injured over 30. A 19 year old driver was texting just before his pick up truck was involved in a horrible accident with two school buses and a tractor trailer.

I myself have been guilty of texting or emailing while driving. I have always felt I was careful, but I am guessing that the 19 year old driver who caused the horrible Missouri accident also thought they were being careful. So from now on no more texting or emailing from this attorney. Not ever!

Recent New Years Holiday Safest On Record For Tennessee Highways

The short list of numbers has been tallied, and it was announced yesterday that the most recent New Years holiday weekend was the safest one ever on Tennessee’s highways. According to reports from News Channel 5, only two people died over the 78-hour holiday period that ran from 6:00 PM on December 30 to midnight on January 2.

This was a significant decrease over last year, which was then the low record holder according to reports from The Department of Safety and Homeland Security. Their data shows that six people died during the 2010-2011 holiday season.

The two fatal accidents that occurred this year had one commonality–a lack of seat belt use was listed as a contributing factor in both crashes. Alcohol was also determined to be a factor in one of the accidents.

Troopers with the Tennessee highway patrol say that they attribute the fleeting number of fatalities and DUI arrests in recent years to their highly publicized campaigns against drinking and driving that run during the holiday season. These campaigns consist of a large number of sobriety checkpoints being set up across the state at key points and times through out the holiday season, as well as saturation patrols in targeted areas.

41-Car Pileup Along I-75 In Kentucky Injures Eight

Eight people were injured as a result of a 41-car pileup along Interstate-75 in Dry Ridge, Kentucky, Monday afternoon. According to News Channel 5, the accident occurred in the southbound lanes of the highway at approximately 12:22 PM, and is being blamed on hazardous road conditions in the area.

The Kenton County sheriff’s department stated that the chain reaction accident occurred after a vehicle lost control on slick roads caused by snowstorms in the area. It took police around 30 minutes to clear the highway of 23 crashed vehicles and six injured individuals. Those victims were all taken to area local hospitals to be treated for non-life threatening injuries.
