How Do You Know If Your Loved One Has Been Abused In A Nursing Home?

Bed Sores can be prevented with proper care by nursing home staff and with adequate staffing.  Unfortunately,  every day nursing home residents suffer from devastating and sometimes deadly bed sores that can and should be prevented.  When visiting your loved ones, keep an eye out for some of the risk factors that can lead to these painful and deadly sores.

Check the skin on your loved ones’ heels and backside, as well as any other bony areas.  If the areas are red, this indicates the staff is not turning your loved one often enough.  Make sure their skin is being kept moisturized to prevent skin breakdown. Check their diet to make sure they are getting a diet high in protein and that they are being adequately hydrated and fed.  It is also important that if possible your loved ones be able to get moving.  Have the staff make sure they are seated occasionally, turned, and walk around if that is possible. Finally, make sure sheets stay dry and clean and that the staff is providing appropriate hygiene.

Devastating Nursing Home Bill Defeated in Kentucky

After much work against potentially devastating nursing home bills in both the House and the Senate, patients’ rights advocates, including trial lawyers from Hughes and Coleman, were successful in defeating the proposed legislation.  Residents have retained their rights to direct access to the courts and we keep fighting for more staffing, better care, and fewer injuries.  We are proud to have had the opportunity to win this fight.

No elderly resident in a nursing home should settle for lack of staffing, lack of care or abuse.  It is important that we fight for the victims of nursing home abuse in Kentucky and Southern Indiana that aren’t able to fight for themselves.

Concern Raised Over Nursing Home Abuse In Nashville

When we send elderly relatives to live in assisted living facilities, we hope they will receive better care than they can at home. But what happens when the home your loved one is in could possibly be responsible for his or her death?

For example, an 83-year old Alzheimer’s patient died as a result of injuries he sustained in an assault at an assisted living facility in Nashville, Tennessee. According to The Tennessean, the incident occurred on Christmas Eve of last year at Elmcroft of Twin Hills assisted living facility when the victim’s roommate, who was also an Alzheimer’s patient, beat him with a cane. The man was taken to a hospital where he died almost two weeks later.

Reports from the Metro Nashville Police Department show that they were only informed of the beating after the ambulance driver who picked the victim up to take him to the hospital called them. They later found that the home failed to report the assault and cleaned up the scene of the incident before police could investigate.

No charges were ever filed in connection with the incident.

Woman Convicted In Tennessee Nursing Home Abuse Case

A 36-year-old Jonesborough, Tennessee, woman who worked as a certified nursing assistant (CNA) at an area nursing home has been convicted of abuse and neglect of her patients. According to The Johnson City Press, the crimes occurred during her time working at the John M. Reed Nursing Home in January of 2010.

Witnesses stated in testimony that the CNA had on numerous occasions physically abused and threatened patients who upset her. Allegations arose after one of the patients told her daughter, “Not to upset them, because they will be mean to me.”

Nursing home administrators later questioned both the patient and their employee, at which point they determined the claims as true, fired the woman, and notified authorities. The CNA later admitted to the wrongdoing to Washington County Sheriff’s Department investigators, explaining that she has an anger management issue.

A plea agreement was reached in March with the District Attorneys Office, in which the woman pled guilty to four counts of neglect and abuse and received a sentence of up to 15 months in prison from a judge Tuesday. Due to her criminal background, the woman could be released in as little as four and a half months.

Sheila P. Hiestand Named President Of The Kentucky Justice Association

A member of the Hughes & Coleman family was awarded a great honor recently, when she was elected as president of the Kentucky Justice association. Sheila P. Hiestand was elected to the position by the groups more than 1,400 members. The association works to keep Kentucky families healthy and safe by improving the quality of legal representation in the state and offering top-notch legal education.

Sheila graduated from Centre College in 1990 with a double major in English and Spanish, and then continued her education by receiving her Juris Doctorate from the University of Kentucky, College of Law three years later.

Some of Hiestand’s other accomplishments include being chair of the Kentucky Bar Association’s Young Lawyer Section, and becoming a member of the Board of Governors. She was selected for inclusion in the 2009 and 2010 Kentucky Super Lawyers®, and was selected for inclusion in the newest version of Who’s Who in American Law. Also, Sheila was named as the top attorney in Kentucky this year.

Some of her most important work in the community is with the Alzheimer’s Association of Lexington and United Way, where she helps plan and organize the annual Memory Walk.
