We’re Here To Reimburse You For Something That You Lost

Personal injury litigation is not to “make money because someone hurt you”.  It is designed to “reimburse you for something that you lost”.  Insurance companies will tell you repeatedly that they are not charity organizations. Do I have a viable personal injury claim?

Under Kentucky law, a person injured in a car collision or slip and fall incident must pass a “threshold” before he/she can file a personal injury claim.  The injured person must incur at least $1,000 in medical bills OR is disfigured permanently, broke a bone, lost a limb, suffered a permanent injury or died.  These requirements do not apply to injured motorcycle passengers.

Maury County Highway Worker Killed In Accidental Fall

The Centers for Disease Control and Prevention lists tree trimming as being in the top five jobs for the most injuries and fatalities per year, and the Bureau of Labor Statistics estimates that 62 workers in the profession are injured per 100,000 on a yearly basis.

These dangers struck close to home when an arborist with the Maury County Highway Department died yesterday morning after falling from a tree that he was working on. According to reports from WKRN-TV 2 News, the accident happened around 10:00 a.m. Tuesday on Ashwood Road, near Old Zion Road, when the bucket lift the worker was in suffered a mechanical failure.

Mark Blackwood, director of emergency management of Maury County, told reporters that the man was trimming back branches in trees roughly 20 feet in the air when the hydraulic arm on the bucket lift the man was working from snapped and sent the worker falling. He died at the scene from injuries sustained in the fall.

The Occupational Safety and Health Administration has been called in to assist with the investigation into the incident.

“All the employees in the Maury County government are saddened by his death. His family is in our thoughts and prayers,” added Blackwood.

Two Tennessee Drivers Injured After Street Race Ends In Head-On Collision

March 7, 2012

The dangers of illegal street racing became apparent last week after a head-on collision left two people seriously injured. According to reports from WCYB News, the crash happened Tuesday night along Highway 394, in Sullivan County, Tennessee.

Reports of the incident from troopers with the Tennessee Highway Patrol indicate that the 17-year-old driver of a silver Mitsubishi Eclipse may have been racing another vehicle along the rural highway just before the accident occurred. That’s when troopers believe the driver of the Eclipse crossed the centerline in an attempt to pass traffic in front of him. As he tried to pass, he drove into the path of a pickup truck heading in the opposite direction and collided with the vehicle head-on.

Both drivers were transported to local hospitals for treatment. The driver of the pickup was last listed in fair condition at Bristol Regional Medical Center, while the teen driver remains in critical condition at the University of Tennessee Medical Center in Knoxville.

The teen underwent surgery to repair a torn aortic artery Tuesday night and will face several other surgeries in the coming days.
