Unexpected Dangerous Conditions, Who Is Responsible?

Dangerous conditions on property can lead to injuries.  Dangerous conditions can be anything from stairs that are broken to uneven walking surfaces to ice or liquid on the floor. If the owner of the property knows of the existence of these dangerous conditions, but does nothing about it, then they could responsible for any damages that may arise.  Even if they aren’t aware of the existence of the dangerous condition, if it existed for a sufficient length of time that they SHOULD have found out about it, they can still be held responsible. Tennessee Lawmakers Pushing To Require Carbon Monoxide Detectors On RVs

In an effort to keep users of rented recreational vehicles (RVs) safe from the harms of poisoning from the toxic and fatal fume, carbon monoxide (CO), Tennessee lawmakers are aiming to pass a bill that will require CO detectors to be installed on all leased campers.

According to reports from New Channel 5, the piece of legislation, which is sponsored by state Senator Tim Barnes and state Representative Joe Pitts, was passed through both the Senate and House on Monday. The Bill is expected to hit the desk of Governor Bill Haslam and be signed into law soon.

The strict regulations come after five people died from carbon monoxide poisoning in an RV in Clarksville, Tennessee. Investigators determined that fumes from a nearby generator were being sucked into a vent on the vehicle and collecting inside. There was no CO detector in the camper. We send our condolences to the families of those that tragically died.

Memphis Boy Hit And Killed By Bus After School

A 6-year-old Memphis, Tennessee, boy was killed in the parking lot of his school Monday afternoon after being hit by a bus. According to News Channel 5, the accident happened at around just before 3:00 PM at Oakshire Elementary School.

Investigators believe the drizzling rain may have contributed to the accident that happened as the children were loading onto the bus to go to after school care. The deceased boy’s 10-year-old sister told police that the young boy had dropped a book moments before the accident. She continued that he fell and hit his head on the pavement before being struck by the bus. The front blind spot created by the hood of the bus blocked the 67-year-old driver from seeing the fallen boy before he began to move the bus forward. No charges have been filed against the driver despite the accident being avoidable if the arm on the front of the bus had been extended while stopped.

Statistics show that in 1999, 733 children ages 14 and under died, and in 2000, nearly 44,600 children were treated in hospital emergency rooms for pedestrian-related injuries. These numbers have remained steady over the last decade.

Town Of Selmer Settles With Victims Of Dragster Crash

The Board of Alderman for the town of Selmer, Tennessee, have reached an agreement on a settlement for victims of a 2007 crash, in which a drag racer on a parade route killed six people and injured dozens more. News Channel 5 reports that the agreed upon $500,000 will be divided amongst victims who were injured and family members of those killed that sunny, summer day in June.

The agreement was reached Tuesday by the board in order to close the case against the town stemming from the car show fundraising event tragedy. The accident happened at the event to raise money for disabled children, when a crowd gathered around a dragster doing tricks on a road with no guardrails. The car spun out of control and mowed through a cluster of spectators.

No settlement has been reached against the events sponsors also being sued, Larry Price, founder of Cars For Kids, and Flowmaster Mufflers. The driver of the car was also being sued, but filed for bankruptcy several months ago.

Individuals and businesses hosting events have a responsibility to ensure that all patrons will be safe while on the property. If someone is hurt, they may be held liable for that individual’s injury and the associated costs.

Building Collapses And Injures Kentucky Worker

Emergency officials in LaGrange, Kentucky, have freed a man from rubble and debris after a building he was working in collapsed on top of him.

MSNBC reports that authorities were called to a vacant concrete manufacturing facility at 8:24 AM Tuesday morning. Upon arrival at the scene, rescuers found a 25-year old man pinned under wood and metal that had fallen across his body. The reports states that the man was removing parts from the building when the structure collapsed and fell on top of him.

Authorities were able to pull the man from underneath the pile of rubble. He was flown to University of Louisville’s Trauma Unit to be treated for a fracture, as well as chest and stomach pain. Authorities say another man was working at the site as well when the collapse occurred, but he suffered no injuries.

Occupational Safety and Health Administration (OSHA) records show that this is the first accident to be reported at the site.

Often times, workers can easily be compensated for injuries without having to file suit. Insurance companies can be tricky though, and will often deny a legitimate claim.
