Wrongful Death Lawsuit Filed In Connection To Murder Of MTSU Player

May 9, 2012

The family of a Middle Tennessee State University women’s basketball player, who was murdered in her apartment by her roommate, filed a $20 million wrongful death lawsuit against the woman responsible for the murder and the apartment complex where the crime took place. According to News Channel 2, the family is seeking $10 million in punitive damages, as well as an additional $10 million in compensatory damages.

The family states that the apartment complex where the player was murdered was negligent in its decision to continue housing the two women together after repeated reports of problems between the two women stemming from the alleged murderer’s drug use. Attorneys representing the family have stated that the lawsuit was filed to ensure that the woman being held responsible for the death does not profit off of the high-profile case.

The woman’s defense team has maintained that she acted in self-defense after being attacked by the deceased. The defense is attempting to build the case around “Stand Your Ground” laws that have gained recent media attention due to another high-profile case in Florida.

Wrongful Death Lawyers understand just how difficult going through the process of filing a wrongful death lawsuit can be on a family. That is why the Tennessee Injury Lawyers with Hughes and Coleman Injury Lawyers hope that the lawsuit will help the family find a sense of closure to their loss.

Tennessee Brothers Ordered To Pay Nearly $5.5 Million To Sheriff’s Family

April 18, 2012

A Tennessee court has found two brothers are responsible for the death of a sheriff’s deputy that occurred during a shootout in front of their farmhouse nearly six years ago. According to News Channel 5, a judge has ordered the brothers to pay $5 million dollars to the mother of the victim.

The incident occurred on May 11, 2006, at the brothers’ farmhouse located on Barnard Narrows Road. That day, a Roane County Sheriff’s Deputy and a companion went to serve an outstanding warrant at the home for one of the brothers on a charge of failure to appear. A firefight erupted and both the deputy and his companion were killed.

The brothers later claimed the men had come to kill them. Three subsequent trials for each man failed to convict either on any charges in connection with the case.

For the first time in the six years since the incident, a jury found the brothers responsible for the deaths and ordered each brother to pay $2.5 million to the mother of the deputy’s companion, along with an additional $450,000 in damages.

It’s unclear when the family would receive the money though, as neither brother, or an attorney representing them, attended the hearing.

The Tennessee Wrongful Death Lawyers with Hughes and Coleman Injury Lawyers hope that the court’s ruling will help bring closure to the families of the victims who died.

Maury County Highway Worker Killed In Accidental Fall

March 14, 2012

The Centers for Disease Control and Prevention lists tree trimming as being in the top five jobs for the most injuries and fatalities per year, and the Bureau of Labor Statistics estimates that 62 workers in the profession are injured per 100,000 on a yearly basis.

These dangers struck close to home when an arborist with the Maury County Highway Department died yesterday morning after falling from a tree that he was working on. According to reports from WKRN-TV 2 News, the accident happened around 10:00 a.m. Tuesday on Ashwood Road, near Old Zion Road, when the bucket lift the worker was in suffered a mechanical failure.

Mark Blackwood, director of emergency management of Maury County, told reporters that the man was trimming back branches in trees roughly 20 feet in the air when the hydraulic arm on the bucket lift the man was working from snapped and sent the worker falling. He died at the scene from injuries sustained in the fall.

The Occupational Safety and Health Administration has been called in to assist with the investigation into the incident.

“All the employees in the Maury County government are saddened by his death. His family is in our thoughts and prayers,” added Blackwood.

The Tennessee Wrongful Death Attorneys with Hughes and Coleman Injury Lawyers would also like to send their thoughts and condolences to the family of the worker who tragically died because of this terrible accident.

Tennessee Lawmakers Pushing To Require Carbon Monoxide Detectors On RVs

February 29, 2012

In an effort to keep users of rented recreational vehicles (RVs) safe from the harms of poisoning from the toxic and fatal fume, carbon monoxide (CO), Tennessee lawmakers are aiming to pass a bill that will require CO detectors to be installed on all leased campers.

According to reports from New Channel 5, the piece of legislation, which is sponsored by state Senator Tim Barnes and state Representative Joe Pitts, was passed through both the Senate and House on Monday. The Bill is expected to hit the desk of Governor Bill Haslam and be signed into law soon.

The strict regulations come after five people died from carbon monoxide poisoning in an RV in Clarksville, Tennessee. Investigators determined that fumes from a nearby generator were being sucked into a vent on the vehicle and collecting inside. There was no CO detector in the camper. We send our condolences to the families of those that tragically died.

With spring and summer road trips right around the corner, the Tennessee Personal Injury Lawyers with Hughes & Coleman suggest RV owners have the piece of equipment installed before taking off or letting someone else use the vehicle.

Nashville Wrong Way Drunk Driver Injures Self, Kills Another

February 22, 2012

A drunk driver is to blame for a head-on collision in Nashville, Tennessee, that left the driver critically injured and killed an innocent victim. Reports from Channel 5 News indicate that the accident occurred Wednesday around 4:00 AM on Interstate 65, just outside downtown.

Reports of the incident from the Nashville Metro Police Department say that officers believe the 22-year-old driver of a 2006 Lexus RX 330 SUV got onto Interstate 40 going the wrong way at the off-ramp for Broadway. The driver, who admittedly had been drinking, then got onto I-65 North, near the Wedgewood exit. The intoxicated driver then collided head-on with a 2000 Chevrolet Ventura minivan.

The drivers swerved away from each other just before the collision, causing the driver’s side of both vehicles to take the brunt of the force. The driver of the minivan did not survive the crash.

First responders say the driver of the Lexus was alive when they arrived at the scene, but was critically injured and smelled of alcohol. She was airlifted to Vanderbilt Medical Center where she remains. Police say the woman will be arrested and charged once she is released from the hospital.

The Tennessee DUI Accident Attorneys with Hughes & Coleman Injury Lawyers ask that we all do our part to contribute to making our state’s highways safer by never getting behind the wheel after consuming alcohol. It’s a simple choice that will save lives.
