Hopkinsville Man Dies in Early Morning Wreck on Pennyrile Parkway

Hopkinsville’s newest extension to the Breathitt Pennyrile Parkway was closed this morning as emergency crews worked to investigate a fatal, single-vehicle accident.  

Tyler Woodrow, 35, Hopkinsville was traveling southbound on the newly extended parkway when he ran off the side of the road, overcorrected, and flipped his vehicle into the northbound lane. Emergency crews state Woodrow was ejected from his over-turned vehicle and found 10-feet away.

Witnesses say Woodrow appeared to be in a hurry and was attempting to pass a Semi when he lost control of the vehicle.

Woodrow was transported to Jenny Stuart Medical Center in Hopkinsville, where he was pronounced dead shortly after arrival.

State Lawmakers Push For Better Regulations On Hormone Therapy

Several Tennessee state lawmakers are pushing for a crackdown on the growing hormone-replacement industry. The surge for better regulations on the amount and types of hormones that are given at hormone replacement therapy centers comes after numerous patients of one Nashville facility have complained of terrible side effects resulting from the medications they were given there. The patients also told News Channel 5 investigators that they never saw a doctor before receiving the medications.

One of those patients was a state representative and his wife from Pegram, Tennessee. They stated they began hormone-replacement therapy after seeing a commercial praising the numerous benefits it can have. They never experienced those benefits.

Instead, the lawmaker says his wife experienced horrible side effects as the result of testosterone levels becoming too high in her body. Dozens of other patients reported similar reactions to the medications they were given.

The experience prompted the group to push for lawmakers to approve House Joint Resolution 104, which asked the Tennessee Medical and Nursing Boards to set a standard of care for the hormone replacement industry. A week later, a task force created by the board made a policy that requires all medical professionals to personally examine patients before prescribing hormones, and then requires a strict regimen of follow-up examinations as well.

How to Recover Compensation From a “Slip and Fall” Injury?

If you are injured you might be able to recover for injuries from the property owner or possessor where the injury happened. These are often referred to as “Slip and Fall”, “Trip and Fall”, or in general “Premises Liability” claims.  As the names suggest they usually arise from slips or trips and falls causing injuries.

Default Judgment Entered By Respected US District Judge

A very well respected US District Judge from the Eastern District of Kentucky recently entered a Default Judgment in the amount of $11million against a trucking company before his court. Apparently the trucking company was properly served with a lawsuit and did nothing in response. In this scenario the court has discretion to enter a Default Judgment. I suspect this particular Judge (as would most) did more than the bare minimum to communicate with the trucking company before entering this judgment yet it still occurred. Since Kentucky law does not favor Default Judgments the ruling might, with a showing of good cause, be set aside. However if this judgment remains in effect the trucking company’s insurance would not pay on the claim because the company owed a duty of cooperation to its insurer, so the trucking company would need to pay the judgment itself.

The lesson in this for all of us is when you are served with legal papers of any kind, be sure to take the matter seriously.
