Driving around any curve can be intimidating, as you often don’t know what is approaching from the other side. Blind spots around curves can keep you from knowing if another approaching motorist is correctly driving on their side of the road, or if they are negligently crossing over into your lane. Our client, unfortunately, was the victim of a head-on car wreck where the individual who struck her had fallen asleep at the wheel due to the fact that he was under the influence.
The Wreck
When traveling outside of city limits one afternoon, our client was safely and appropriately driving around a curve on the roadway when she was struck head-on by a car coming from the opposite direction. Upon impact, our client’s vehicle was thrown into the guardrail and then bounced off with such force that she was slammed into the other guardrail as well. The vehicle that struck her had crossed into her lane of traffic, and didn’t slow down prior to the collision.
Due to the impact of the guardrails on the vehicle, both airbags, front and driver-side, deployed within our client’s vehicle.
Upon police and EMS arrival, she was immediately transported to the Bowling Green Medical Center, where she underwent diagnostic tests for the injuries caused by the wreck. It was determined she had sustained a fractured wrist with multiple areas of internal swelling, external bruising covering her body, and a torn ligament in her wrist. She was forced to undergo three separate surgeries in attempt to fix the injuries that the defendant had caused.
A witness on the scene reported that she had been following the defendant’s vehicle prior to the collision and had noticed it was veering all over the road. Upon further police investigation, it was determined that the defendant was intoxicated and had fallen asleep at the wheel. He had no recollection of the wreck.
Car Wreck Statistics
In 2020 alone, 28.6% of fatalities in traffic accidents between vehicles were in head-on collisions, accounting for around 5,000 deaths nationwide. In addition, 35% of fatal motor vehicle accidents occurred due to impaired driving, causing 13,695 deaths nationwide.
In 2019, in Kentucky, there were 150 traffic fatalities due to alcohol-impaired driving. Driving under the influence continues to be a threat on roadways all across America, with an estimated 11% of Americans driving under the influence in 2019. Over 10,000 American lives are lost to drunk and drug-impaired driving each year, which accounts for one-third of all traffic deaths. This is unacceptable.
