The team of legal professionals at Hughes & Coleman Injury Lawyers successfully obtained a $187,000 settlement for a man injured in a rear-end collision in Tennessee. How Did the Car Wreck Occur?
On September 26th, 2023, H was driving down the Jefferson Pike when he spotted a school bus on the other side of the road with its stop arm out letting children off the bus. In Tennessee, drivers are required to stop and remain stopped when this occurs, as per Tennessee Code Title 55. H and the two cars in front of him obeyed and stopped to yield to the school bus, leaving plenty of room between each vehicle. While waiting for the school bus to resume motion, H looked into his rear-view mirror and noticed the vehicle behind him speeding towards him. He braced for impact and was subsequently struck by the speeding vehicle, resulting in a rear-end collision.
According to the police report, when the police arrived at the scene, it was determined that the driver who struck H had gotten distracted by his child in the backseat, which pulled his attention away from the road. When his eyes returned to the road, he noticed the stopped vehicles but did not have time to stop. This resulted in H being struck with almost full force, causing severe injuries and damages.
What Injuries Were Sustained in the Rear-End Collision?
Rear-end collisions can be especially damaging to the neck and spine due to the angle of impact. These types of wrecks typically result in whiplash, in addition to other physical injuries.
After the incident, H quickly determined that he had sustained whiplash and neck strain. Further, he was experiencing constant pain throughout his entire back, which was also affecting his arms and shoulders. H also reported that he was suffering from headaches and dizziness, all since after the accident.
To add to his bodily injuries, H’s car sustained disabling damage, leaving him without a vehicle.
How Did the Hughes & Coleman Team Help?
When H first contacted Hughes and Coleman Injury Lawyers, our intake team took a detailed statement to understand exactly what had occurred. Afterwards, our team of experienced injury law professionals began collecting evidence and records for use in an injury claim of this kind. Some of the evidence and documents our team gathered included medical bills, wage information, the police report for the incident, insurance information from both drivers, and the extent of the car’s damage.
After reviewing the documents, our injury lawyers realized the extent of H’s injuries. The driver of the vehicle that struck H’s car was determined to be the defendant on the claim, and our team immediately began negotiations with his insurance company. Since the defendant was distracted while driving, and H was obeying the rules of the road, it was clear the person who struck H would be deemed at-fault for the rear-end collision.
The initial offer from the defendant’s insurance company was $25,000. Our legal team knew the extent of H’s injuries, as well as the property damage to his vehicle, far exceeded this pitiful amount. The experienced attorneys at Hughes and Coleman proceeded to decline the initial offer and continued to fight for what H really deserved.
After negotiations from both sides, we were able to secure a $187,000 settlement for H to help him recover from the losses he incurred due to the wreck.
Cases like these stand as stark reminders that insurance companies are out to save every dollar they can, and they don’t have your best interests in mind.
