    THE RULING OF HAMILTON COUNTY CIRCUIT COURT

    On March 18, 2022, the Hamilton County Circuit Court found Arlene Morrison, who was represented by Hughes & Coleman Injury Lawyers in a fight that lasted over three years with not only the insurance company but also Hamilton County itself, entitled to a judgement of $713,179.19. Given limitation caps of the defendant, payment was remitted to a total sum of $325,000.

    WHEN A HEADACHE AFTER A CAR WRECK LEADS TO SURGERY

    On April 6, 2018, Ms. Morrison was rear-ended by an ambulance. The impact of this wreck, like many others, began with a headache. Ms. Morrison was taken to the emergency room after the wreck and was then released. Less than 72 hours later, she would return, and months later, she would undergo surgery to fuse two of her vertebrae together with the hope of resolving the anguish of the pain.

    LIFE BEFORE AND AFTER THE WRECK

    At the time of the car wreck, Ms. Morrison found the greatest joy in her family and her five children, three of which currently serve our country in the military. For her other two children, she was a stay-at-home mom who was active and enjoyed bicycling, riding motorcycles, Bible journaling, and expressing herself through various crafts. She exercised almost daily and successfully lost approximately 80 to 90 pounds prior to the wreck. However, her highly active lifestyle changed to virtually inactive after the wreck.

    THE TRIAL AND EXPERT TESTIMONY

    During the trial, Hughes & Coleman Injury Lawyers called upon expert testimony to ensure all relevant facts were presented regarding the future medical expenses Ms. Morrison would require. While the defendants attempted to sway the court through expert testimony to believe that long-term care was not required for Ms. Morrison, the court found those opinions to be unreliable and untrustworthy and that Ms. Morrison will experience another 30 years of pain management expenses to go along with a lifetime of partial disability and an unsightly surgical scar.

    THE JUDGMENT

    Medical bills, future medical bills, pain and suffering, loss of enjoyment of life (past and future), permanent injury and scarring were all damages included in the court’s judgment.
