The legal team at Hughes & Coleman Injury Lawyers in Louisville helped a family successfully obtain a $245,000 settlement for a T-Bone collision with a drunk driver. To ensure confidentiality, we will refer to the victims in this case as Mr. A (father) and Little A (daughter) throughout the article.

How Did the Louisville T-Bone Accident Occur?
At approximately 4 AM on November 11, 2023, Mr. and Little A were driving their 2009 Ford Focus down Broadway in Louisville. As they crossed the intersection at Preston St., their car was T-boned. Disoriented and shocked by what had just happened, both victims didn’t recognize they had injuries.
After a wreck, the adrenaline and shock felt by the victims often lessens the pain their injuries may be causing. Due to this, many victims delay seeking treatment, or even worse, opt-out of treatment overall. Doing so can cause lifelong issues, which is why we encourage all accident victims to seek medical treatment for their injuries as soon as possible after the incident.
When police arrived at the scene of Mr. and Little A’s wreck, the defendant was attempting to flee the scene. She had her foot on the gas pedal, ready to go, but didn’t realize that she had the car in park. As they approached the vehicle, officers noticed and reported the smell of alcohol.
In an effort to understand the circumstances that surrounded the wreck, Louisville police officers did several field sobriety tests. The defendant was unable to touch her finger to her nose and walk the line. When the defendant submitted to a breathalyzer test, the reasoning for her disorientation became clear. Her Blood Alcohol Content (BAC) was .214! That is more than 2.5 times the legal limit in Kentucky! After her attempted hit and run as well as her failure to complete sobriety tests, the defendant was placed under arrest.
Unfortunately, drunk driving accidents aren’t rare in Louisville, but fortunately, Mr. and Little A contacted the Louisville car accident lawyers at Hughes & Coleman to learn more about their rights.
What Injuries Were Sustained in the Wreck?
Although Mr. and Little A didn’t recognize they were injured at the time of the car accident, they began to feel the pain in the days after the wreck.
A few days following the incident, Mr. A received medical care for injuries that included right-sided upper abdominal pain, lower chest pain, right hip pain, right-side pain, neck pain, cervical facet syndrome, lower back pain, lumbar facet joint pain, and right rib pain. An MRI showed that Mr. A had a disc herniation that resulted in moderate to severe bilateral neuroforaminal encroachment and bilateral exiting C5 nerve impingement. His back pain was severe, and he required ongoing treatment to help with that.
Additionally, Little A (who was driving) sought medical attention for lumbar (back) pain, neck pain, right knee pain, lower back pain, cervical facet syndrome, lumbar facet joint pain, and a one- to two-millimeter annular bulge effacing the ventral surface of the thecal sac at L5-S1. Little A required multiple MRIs which revealed various strains. With those results, she submitted to steroid injections intermittently to address the pain and inflammation from her injuries, which remain ongoing.
How Did the Hughes & Coleman Team Help?
Mr. and Little A contacted Hughes & Coleman Injury Lawyers in Louisville to learn more about their options and rights as victims of a drunk driving lawsuit. Our intake team learned more about the circumstances surrounding the car wreck and the injuries sustained. After understanding the incident further, our intake team connected Mr. and Little A with an experienced car accident attorney within our firm.
Once our professional legal and investigative teams collected the evidence necessary, an attorney at Hughes & Coleman drafted separate demand letters for each victim. The demand letters included detailed accounts of the wreck and a list of each victim’s injuries. They also included any and all treatment each client had received to date and what treatment would be required in the future.
This case was unique because the defendant was excessively drunk (driving at over 2.5 times the legal limit in Kentucky) and attempted to leave the scene. Due to those conditions, it was evident that negligence, recklessness, and outrageous disregard for human life were also in play.
The initial offer for Little A’s claim was $78,000. The accident lawyers at Hughes & Coleman negotiated to get the policy limit from the defendant’s insurance company. Because the defendant was underinsured for the damages caused to Little A, the car accident attorney moved on to pursue a UIM claim from Little A’s insurance carrier. The initial offer from Little A’s Underinsured Motorist (UIM) coverage was $7,878.00. Her Hughes & Coleman lawyer set off to continue negotiations, and were able to secure $20,000 from UIM, bringing Little A’s total settlement to $120,000.
As for Mr. A, the insurance companies gave the initial offer of $100,000 for his injuries and $8,547.00 from UIM. Mr. A accepted the $100,000 offer, but the Hughes & Coleman legal team knew he deserved more from UIM. After negotiations, we were able to secure $25,000 from UIM, bringing the total client settlement to $125,000.
With Little A receiving $120,000, and Mr. A receiving $125,000, the family received a cumulative total of $245,000 for their losses. This compensation helped them recover from the accident, continue the medical support they needed and get back on their feet.
