Medical malpractice can encompass any situation in which a doctor fails to uphold their duty of care, and a patient suffers injury as a result. The Hughes & Coleman Injury Lawyers team has helped many malpractice victims recover damages. We handle the following types of malpractice cases and more:
A misdiagnosis occurs when a doctor makes an incorrect diagnosis of a patient’s symptoms, despite having enough information to make the correct diagnosis.
When a doctor misdiagnoses a serious medical condition, the patient may suffer a long-term injury, as their condition is often more advanced and difficult to treat by the time the correct diagnosis occurs.
Ailments that doctors often diagnose incorrectly include:
We can hold your doctor accountable for misdiagnosing your ailment.
Similar to misdiagnosis, failure to diagnose is where your doctor does not pick up on your symptoms and recognize that you have a serious condition.
We can take action against your doctor for failing to diagnose your condition. We can collect evidence and build a case that shows your doctor had enough information to make a diagnosis but failed to do so.
When a doctor is negligent in treating a patient who is pregnant or giving birth, they put two lives at risk. If you suffered harm during your pregnancy, or your child suffered a birth injury, we may be able to hold your doctor liable and recover damages on your behalf.
Prescription drugs are powerful agents. They can help you overcome serious medical conditions, and they can even save your life. But they can also create unnecessary complications and put your life at risk. It all depends on whether your doctor prescribes and administers them correctly.
If you suffered injury after taking prescription medication, the doctor, pharmacist, or another health care provider involved in the process may be liable. We can investigate and determine who was responsible and then collect evidence to build a case against them.

Kentucky has one of the nation’s strictest statutes of limitation for medical malpractice lawsuits. From the date the malpractice occurred, you have only one year to take legal action. If you fail to do so, you will be unable to sue and recover compensation for your injuries.
Exceptions May Apply
One caveat, known as the discovery rule, applies in certain situations. If you do not discover that you were a victim until after the fact, and the court believes you had no way of knowing until that point, then the clock starts running at the time of discovery.
Be aware, though, that if you use the discovery rule, the other side might try to invalidate your case by arguing that you knew or should have known about the alleged malpractice earlier. Also, there is an absolute time limit of five years from the date of the malpractice, regardless of when you discovered it. This is called the statute of repose.
